Welcome to NewArtFiction. These Terms of Service ("Terms") govern your access to and use of our platform, including our website, services, and applications (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with these Terms, you may not access or use our Platform. These Terms constitute a legally binding agreement between you and NewArtFiction.

1. Platform Usage

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

1.3 Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform in any way that would damage, disable, overburden, or impair the Platform or interfere with any other party's use of the Platform.

2. User Responsibilities

2.1 Customer Responsibilities

As a customer, you are responsible for providing accurate information when placing orders, communicating clearly with artisans, and making payments as agreed. You agree to respect the intellectual property rights of artisans and to use their products only as permitted.

2.2 Artisan Responsibilities

As an artisan, you are responsible for providing accurate descriptions of your products, delivering products as promised, and maintaining the quality standards described in your listings. You agree to comply with all applicable laws and regulations related to your products and services.

2.3 Prohibited Activities

You agree not to engage in any activities that violate these Terms, including but not limited to fraud, misrepresentation, harassment, spamming, or any illegal activities. We reserve the right to terminate your access to the Platform for violations of these Terms.

3. Liability

3.1 Limitation of Liability

To the maximum extent permitted by law, NewArtFiction shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your access to or use of the Platform.

3.2 Disclaimer of Warranties

The Platform is provided "as-is" and "as available" without warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

3.3 Indemnification

You agree to indemnify, defend, and hold harmless NewArtFiction and its affiliates, directors, employees and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Platform or violation of these Terms.

4. Intellectual Property

4.1 Platform Content

The Platform and its original content, features, and functionality are owned by NewArtFiction and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2 User Content

By posting, uploading, or otherwise making available any content on the Platform, you grant NewArtFiction a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing the Platform.

4.3 Artisan Works

Artisans retain all intellectual property rights to their original works. Customers may not reproduce, distribute, or create derivative works based on purchased items without explicit permission from the artisan, unless otherwise specified in the product description.

5. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the applicable laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
